Isn’t Santa just a stand in for the society that has locked them up for formative years? Something that watches and judges, telling them that they got what they deserved based on their behavior? Surely they have to have noticed that Saint Nick, like the judicial system itself, tends to look more favorably upon rich children. He is fat, white, past middle age, and holds all the cards.

  • By Anonym

Do we identify with a criminal in that we too secretly long to be judged? Popularly, being ‘judgemental’ is ill thought of and resented. But what if we want our deeds, our natures, our very souls to be summed up and evaluated? A line to be drawn under our acts to date? A punishment declared, amends made, the slate wiped clean? A born-again Christian, trying to explain his new sense of freedom, once said to me, "All my debts are paid".

He had been always escaping, always rebelling, always fighting against authority, and always being flogged. There had been a whole lifetime of torment such as this; forty-two years of it; and there he stood, speaking softly, arguing his case well, and pleading while the tears ran down his face for some kindness, for some mercy in his old age. 'I have tried to escape; always to escape,' he said, 'as a bird does out of a cage. Is that unnatural; is that a great crime?

It is quick to over punish and uninterested in rewarding good behavior. What would we say about an individual who had these characteristics? Mean? Cruel? Heartless? Mindless? Hypocritical? Stupid?

Look, people need to conform the external reality they face daily with this subjective feeling they likewise experience constantly. To do this they have two options. First, they can achieve what passes for great things. Now the external reality matches their feeling; they really are better than the rest and maybe they'll even be remembered as such. These are the ambitious people, the overachievers. These are also, however, the people who go on these abominable talk shows where they can trade their psychoses for exposure on that box, modernity's ultimate achievement. Not that this tact, being ambitious, is not the preferred course of action. The reason is it's the equivalent of sticking your neck out which we all know is dangerous. Instead many act like they have no ambition whatsoever. Their necks come back in and they're safe. Only problem is now they're at everyone else's level, which we've seen is untenable. The remedy of course is that everyone else needs to be sunk. This helps explain racism's enduring popularity. If I myself don't appear to be markedly superior to everyone else at least I'm part of the better race, country, religion et cetera. This in turn reflects well on my individual worth. There are other options, of course. For example, you can constantly bemoan others' lack of moral worth by extension elevating yourself. Think of the average person's reaction to our clients. Do these people strike you as so truly righteous that they are viscerally pained by our clients' misdeeds or are they similarly flawed people looking for anything to hang their hat on? The latter obviously, they're vermin.

Criminal justice" is what happens after a complicated series of events has gone bad. It is the end result of failure--the failure of a group of people that sometimes includes, but is never limited to, the accused person.

Many critics complain that the criminal justice system is heavy-handed and unfair to minorities. We hear a great deal about capital punishment, excessively punitive drug laws, supposed misuse of eyewitness evidence, troublingly high levels of black male incarceration, and so forth. So to assert that black Americans suffer from too little application of the law, not too much, seems at odds with common perception. But the perceived harshness of American criminal justice and its fundamental weakness are in reality two sides of a coin, the former a kind of poor compensation for the latter. Like the schoolyard bully, our criminal justice system harasses people on small pretexts but is exposed as a coward before murder. It hauls masses of black men through its machinery but fails to protect them from bodily injury and death. It is at once oppressive and inadequate.

Men often have grievances against prominent and powerful persons. Historically, the grievances of the powerless against the powerful have furnished the steam for the engines of revolutions. My point is that in many of the famous medicolegal cases involving the issue of insanity, persons of relatively low social rank openly attacked their superiors. Perhaps their grievances were real and justified, and were vented on the contemporary social symbols of authority, the King and the Queen. Whether or not these grievances justified homicide is not our problem here. I merely wish to suggest that the issue of insanity may have been raised in these trials to obscure the social problems which the crimes intended to dramatize.

Providing adequate representation even for defendants who appear guilty is the best way to protect those who are not.

No more self-defeating device could be discovered than the one society has developed in dealing with the criminal. It proclaims his career in such loud and dramatic forms that both he and the community accept the judgment as a fixed description. He becomes conscious of himself as a criminal, and the community expects him to live up to his reputation, and will not credit him if he does not live up to it.

  • By Anonym

No one should ever be wrongfully deprived of their rights to liberty and freedom without just cause, yet in the past 25 years alone thousands of people have been wrongfully convicted and sentenced to tens of thousands of years in prison.

Seven thousand of them were indicted and arraigned, and then they entered the maw of the criminal justice system—right here—through the gateway into Gibraltar, where the vans were lined up. That was about 150 new cases, 150 more pumping hearts and morose glares, every week that the courts and the Bronx County District Attorney's Office were open. And to what end? The same stupid, dismal, pathetic, horrifying crimes were committed day in and day out, all the same. What was accomplished by assistant D.A.'s, by any of them, through all this relentless stirring of the muck? The Bronx crumbled and decayed a little more, and a little more blood dried in the cracks. The Doubts! One thing was accomplished for sure. The system was fed, and those vans brought in the chow.

  • By Anonym

The offender must be able to give something back. But criminals are most often poor people. They have nothing to give. The answers to this are many. It is correct that our prisons are by and large filled with poor people. We let the poor pay with the only commodity that is close to being equally distributed in society: time.

Statistically, the odds that any given rape was committed by a serial offender are around 90 percent," Lisak said. "The research is clear on this. The foremost issue for police and prosecutors should be that you have a predator out there. By reporting this rape, the victim is giving you an opportunity to put this guy away. If you decline to pursue the case because the victim was drunk, or had a history of promiscuity, or whatever, the offender is almost certainly going to keep raping other women. We need cops and prosecutors who get it that 'nice guys' like Frank are serious criminals.

There is one key area in which Zuma has made no attempt at reconciliation whatsoever: criminal justice and security. The ministers of justice, defence, intelligence (now called 'state security' in a throwback to both apartheid and the ANC's old Stalinist past), police and communications are all die-hard Zuma loyalists. Whatever their line functions, they will also play the role they have played so ably to date: keeping Zuma out of court—and making sure the state serves Zuma as it once did Mbeki.

[T]here are some human rights that are so deep that we can't negotiate them away. I mean people do heinous, terrible things. But there are basic human rights I believe that every human being has. The Universal Declaration of Human Rights in the United Nations says it for me. And it says there are two basic rights that can't be negotiated that government doesn't give for good behavior and doesn't take away for bad behavior. And it's the right not to be tortured and not to be killed. Because the flip side of this is that then when you say OK we're gonna turn over -- they truly have done heinous things, so now we will turn over to the government now the right to take their life. It involves other people in doing essentially the same kind of act." (PBS Frontline: Angel on Death Row)

There is no greater threat to a free and democratic nation than a government that fails to protect its citizen’s freedom and liberty as aggressively as it pursues justice.

The relevant question is not whether back then a few extraordinary individuals could overcome a system strongly weighted against them or whether today an admittedly far greater number requiring far less talent can succeed. The real question is whether it's harder for the people in this audience to succeed be they extraordinary, average, or below average. If it is, and I think it obvious that it is, then that's untenable in a country that purports to provide equal opportunity for all. Now of course you'll dispute my claim that it is more difficult to succeed for them. You say the battle's over. I say not only is it not over but you yourself are stationed on the frontline of the battle and have been all these years. This room and the criminal justice system as a whole is the frontline. This is where modern-day segregation lives on.

The United States has experienced more than two centuries of political stability. When viewed against the background of world history, this is remarkable. The First Amendment has played a singularly important role. When citizens can openly criticize their government, changes come about through orderly political processes. When grievances exist, they must be aired, if not through the channels of public debate, then by riots in the streets. The First Amendment functions as a safety valve through which the pressures and frustrations of a heterogeneous society can be ventilated and defused.

With respect to parole, in 1980, only 1 percent of all prison admissions were parole violators. Twenty years later, more than one third (35 percent) of prison admissions resulted from parole violations. To put the matter more starkly: About as many people were returned to prison for parole violations in 2000 as were admitted to prison in 1980 for all reasons. Of all parole violators returned to prison in 2000, only one-third were returned for a new conviction; two-thirds were returned for a technical violation such as missing appointments with a parole officer, failing to maintain employment, or failing a drug test.

The main difference is that the enlightened believe that the poor criminal should be rehabilitated while the righteous believe that the immoral criminal should be locked up in jail. Since almost the only available system of rehabilitation in America is to be locked up in jail, the difference remains highly abstract.
